great lodge, great rates! Thank you for choosing the Wintersgreen Lodge for your vacation destination. We hope that you will find your stay peaceful, enjoyable and restful. The balance of this Agreement is designed to ensure that the Lodge is always in top condition and worry-free. If there is anything you need, just give us a call at (877) 885-3630 or email us at info@wintersgreen.com. Agreement 1. RESERVATIONS. a. FIRST COME, FIRST SERVE. Reservations are confirmed only upon full payment for your visit. The Lodge accepts all major forms of payment for your stay. You may also pay by check via mail by sending your reservation request along with payment to our mailing address. b. SECURITY DEPOSIT. A security/damage deposit of $500.00 is required. This must be paid for when booking the reservation. The deposit is NOT applied toward rent; however, it is fully refundable within fourteen (14) days of departure, provided the following provisions are met. i. No damage is done to the Lodge or its contents, beyond normal wear and tear. ii. No charges are incurred due to contraband, smoking, pets, or collection of rents or services rendered during the stay. iii. All debris, rubbish, and discards are placed in garbage containers; all dishes are placed in the dishwasher and cleaned; and all used towels and sheets placed by clothes washer. iv. All keys are left on the kitchen table and unit is left locked. v. All charges accrued during the stay are paid prior to departure. vi. No linens are lost or damaged. vii. NO early check-in or late check-out, unless otherwise arranged. viii. The renter is not evicted by the owner (or representative of the owner), the local law enforcement, or the security company employed by the Lodge. ix. No other violation of this Agreement has taken place. c. MINIMUM STAY. At this time, the Lodge does NOT require a minimum stay. d. OCCUPANCY. Minimum occupancy is one (1) adult. Maximum occupancy is fourteen (14) total adults and children. The Lodge has four (4) bedrooms and three (3) bathrooms. Each bedroom is currently equipped with one queen bed capable of sleeping two (2) adults. Additionally, the upper and lower family rooms are equipped with sleeping couches capable of sleeping one (1) adult or two (2) children per couch. e. FALSIFICATION. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in. 2. PAYMENT. a. BASE RENTAL INCLUSIONS. The rental fee includes the use of the Lodge and its amenities during your stay. The kitchen is stocked with a substantial count of dishes, silverware, glassware, and cooking utensils. The bathrooms are stocked with clean bathmats, bath/face/hand towels, and sundry items. The bedrooms are made up with clean sheets. All utilities, including power, local phone service, propane gas, water, sewer, garbage collection, satellite television, and internet access, are included for your enjoyment. b. BASE RENTAL EXCLUSIONS. The rental fee does NOT include any cleaning deposits, appropriate taxes, daily maid services, laundry services, food supplies, beverage supplies, or any other item, product, or service not expressly included. c. DEPOSITS. Deposits are collected at the time you reserve the Lodge for your stay. d. TAX CALCULATIONS. The Lodge will collect 8% for Idaho State Sales and Lodging taxes and remit them to the proper authorities. e. RATE CHANGES. Lodge rates are always subject to change without notice. Additionally, the rates more than one (1) year in advance of the date of your inquiry are subject to change without notice. f. RETURNED CHECKS. A $30 service charge will be incurred for any returned check. g. UNPAID BALANCES. All unpaid balances will be charged interest at 2.0% per month until paid in full and are subject to collection efforts with the addition of reasonable attorney’s fees, court costs, and collection expenses if they remain unpaid. 3. CANCELLATIONS & REFUNDS. Due to the high demand for rental cabins in our area and the advanced booking nature of the business, all reservations are subject to the following rescheduling and cancellation policies. Many of our guests are family reunions or once-a-year fishing trips – potential guests go elsewhere when we are booked during their window of opportunity. We assume an increasing risk of not being able to rebook the Lodge as time grows closer to the date of your scheduled visit. a. RESCHEDULING. You may reschedule your confirmed reservation one (1) time if all of the following conditions apply: i. The rescheduled stay falls in the same calendar year as the original stay. ii. The rescheduled stay will be charged the higher rate between the original stay and the rescheduled stay. iii. The rescheduled stay cannot be cancelled or further rescheduled and is fully non-refundable. iv. You may not reschedule a stay if your original stay is scheduled within the next 30 calendar days. b. CANCELLATIONS. If you choose not to reschedule, the following cancellation conditions apply: i. Written notification prior to 120 days prior to your stay will result in the refund of your entire reservation amount, less $50.00 for processing. ii. Written notification between 120 and 91 days prior to your stay will result in the immediate refund of 75% of your reservation, less $50.00 for processing. If we are able to re-book the Lodge at an equal or better rate than your reservation during the same time period, we will happily refund the remaining 25% of your reservation. iii. Written notification between 90 and 61 days prior to your stay will result in the immediate refund of 50% of your reservation, less $50.00 for processing. If we are able to re-book the Lodge at an equal or better rate than your reservation during the same time period, we will happily refund the remaining 50% of your reservation. iv. Written notification between 60 and 31 days prior to your stay will result in the immediate refund of 25% of your reservation, less $50.00 for processing. If we are able to re-book the Lodge at an equal or better rate than your reservation during the same time period, we will happily refund the remaining 75% of your reservation. v. There are NO refunds for cancellation if your stay is scheduled within the next 30 calendar days, even if we are able to re-book it. c. REFUNDS. Excepting the refund of Security Deposits, which occurs at the end of every stay, all refunds are processed on demand. You must notify us, in writing, of your refund request. Upon notification, we will notify you within three (3) business days of the status of your request. Refunds are always credited back to the original payment source, such as charged credit card or deposited company check. 4. LODGE USE. a. CHECK-IN. Unless previously arranged, check-in may begin at 3:00 P.M. on the start day of your reservation. b. KEYS. You will be provided with two complete sets of marked keys to access all public areas of the Lodge. Upon departure, keys must be left on the kitchen counter and the door locked behind you. c. CHECK-OUT. The check-out procedures are outlined in a folder at the Lodge. There is a final walk-through checklist you are required to fill out upon your departure. For your own protection, you will be responsible for completing this checklist to ensure nothing has been lost or stolen and to report any repairs, comments, etc., to us. Unless otherwise arranged, check-out time is at 10:00 A.M. on the end day of your reservation. This allows us adequate time to clean up and prepare for our next guests. d. SMOKING. Smoking is NOT permitted on the property, either inside or outside. Violation of this restriction will result in a forfeiture of your deposit. e. PETS. Pets are NOT permitted on the property, either inside or outside. Violation of this restriction will result in a forfeiture of your deposit. f. CLEANING. The Lodge will be prepared and cleaned thoroughly prior to your visit. i. NO DAILY MAID SERVICE. While linens and bath towels are included in the cabin, daily maid service is not included in the rental rate and is not available. ii. CHECK-OUT STATUS. At the end of your stay, all dishes are to be washed in sink or placed in dishwasher; all bathroom linens are to be collected and deposited in the laundry area; and that linens from all disturbed beds be stripped and deposited in the laundry areas. g. DAMAGES. Please be aware that Wintersgreen Lodge is our second home. We appreciate your being a guest there and expect that it will be treated with respect. Any damages to our home or negligence resulting in damage to our home or contents (including theft) will result in either the costs to repair or 100% of the replacement cost being deducted from the Security Deposit or billed to you if the damage or loss of contents is greater than the Security Deposit. h. LOSSES. We are not responsible for articles left in the Lodge but will do our best to return them to you. There will be a $10 charge in addition to shipping charges for handling the return of any articles found by housekeeping. Although we inspect our property often, some items of disrepair may go unnoticed by us. Please report any items of disrepair to us immediately and we will have them repaired as soon as possible. We cannot give refunds for mechanical failures or disruptions of utilities including power, internet, satellite services or water (provided by electrical pump in a well). i. WAIVER & HOLD HARMLESS. You are responsible for any property damage, accident/injury/death to any person or loss sustained by any person, including loss of money, jewelry, and other items of personal property while at the Lodge. You and your guests hereby agree to indemnify and hold Wintersgreen Lodge and its owners, harmless of any and all claims, including those of third parties, arising out of or in any way related to your use of the cabin or the items of personal property therein. Guest(s) assumes the risk of injury or other losses relating to use of the cabin or any activities or services ordered through Wintersgreen Lodge and will hold Wintersgreen Lodge and its owners and agents harmless with respect thereto. j. GOOD NEIGHBOR POLICY. The Wintersgreen Lodge is located on the banks of the Henry’s Fork of the Snake River. The property is bounded by a private residence on either side of the fence line. Additionally, the river is a popular place for anglers – Idaho laws permit anglers to traverse the river and access the banks of the river to the seasonal high-water mark without restriction. At all times and in all places, you and your co-guests will be respectful of private property, including the right of “quiet enjoyment,” which means consideration for noise, light, and other nuisances in traditionally quiet hours. k. PARKING. The Lodge has more than adequate paved parking on site for the occupancy levels anticipated. 5. GENERAL WEATHER POLICY. The cabin is located on a county maintained paved road; however, on very rare occasions the road may not be plowed immediately during your stay. If you book a winter reservation, please be aware that 4x4’s/chains may be required to access the Lodge. You are encouraged to bring snow shoes, shovels, and any other equipment you feel necessary to get in and out of the cabin. We offer no refunds for snow/winter conditions. 6. ENTIRE AGREEMENT. Unless otherwise agreed to in writing by all parties, this Agreement is the entirety of the agreement between Wintersgreen, LLC, and its Lodge Guests. |
